The appellants in New Jersey Physicians, Inc. v. Obama have today filed their opening brief in the United States Court of Appeals for the Third Circuit. You may recall that the District Court dismissed their complaint on standing grounds. Moreover, the District Court's holding was extremely factbound: that the plaintiffs had failed to make any factual allegations concerning the present financial impact on them of having to acquire minimally adequate health coverage by January 1, 2014. It is only that very narrow, fact-specific question that is up on appeal.
